1. Purpose

This document contains the General Conditions of Sale (hereinafter the “Conditions”) that regulate the purchase of our products through the use of the website https://bodegasoscarperez.com, owned by Óscar Pérez Nanclares (BODEGAS ÓSCAR PÉREZ), Calle Olmo 15, Briones (La Rioja, Spain), and with Tax ID No. 16604329P – email: hola@bodegasoscarperez.com

These Conditions bind users (hereinafter “You”/”your”/”the Buyer”/”the User”) with the owner of the website (hereinafter “we”/”our”/”the Seller”), and establish the rights and obligations of both in relation to the products that BODEGAS ÓSCAR PÉREZ offers through its website (hereinafter referred to as “the Product”/”the Article” or jointly as the “Products”). “Products”/”Articles”/”BODEGAS ÓSCAR PÉREZ Products”).

BODEGAS ÓSCAR PÉREZ may modify these Terms and Conditions at any time and without prior notice. Therefore, before placing an order or authorizing any payment, please read these Terms and Conditions and our Privacy Policy carefully.
By using our website and placing an order through it, you unreservedly agree to be bound by these Terms and Conditions and our Privacy Policy. Therefore, if you do not agree with all of the Terms and Conditions and the Privacy Policy, you should not place any order. The Terms and Conditions published on the website at the time you begin the purchasing process will govern the contract.

By placing an order through our website, you warrant that you are over 18 years of age and have the legal capacity to enter into binding contracts.

We ship BODEGAS ÓSCAR PÉREZ Products throughout Spain. For international shipments, please contact us at hola@bodegasoscarperez.com.

3. Product Availability

All orders for BODEGAS ÓSCAR PÉREZ Products are subject to availability. If items are out of stock, we promise to inform you immediately, replenish them as quickly as possible, and provide you with information about products with similar characteristics that you may order.

Purchasing Process

To purchase from BODEGAS ÓSCAR PÉREZ, you must follow the online purchasing process until payment is made. After this, you will receive an email acknowledging receipt of your order.
The purchasing process is very simple. Just follow these steps:

Choose the product.

  • View the product(s) you are interested in. With a click, you will see an enlarged photo to see the details, composition, technical characteristics, available sizes, reference number, price, and more information.
  • Select a product and add it to your cart. You can then choose to continue shopping or confirm the order.
  • Enter the shipping information for your order.
  • Select a payment method: Credit Card or bank transfer.
  • Authorize payment to confirm the order.
  • Once payment is authorized, you will receive an initial email confirming your order, and another email upon shipment, along with a tracking link so you can check its status and invoice.

If you do not receive the order confirmation email within twelve (12) hours of completing the purchase, it will be your responsibility to confirm approval of the transaction with BODEGAS ÓSCAR PÉREZ by sending an email notifying us of this circumstance to hola@bodegasoscarperez.com.

Your authorization of payment and confirmation of the order constitutes your full and complete acceptance of the price, the Product description, these Terms and Conditions, which shall be the sole terms applicable to the contract thus concluded, and our Privacy Policy.

You agree to provide us with your true and correct email address, postal address, and/or other contact information and consent to us using this information to contact you regarding your order if necessary. If you do not provide us with all the information we require, we will not be able to process your order.

By placing an order through our website, you warrant that you are fully authorized to use the chosen payment method and, if applicable, a credit card. Only individuals with the legal capacity to enter into contracts relating to the BODEGAS ÓSCAR PÉREZ product class may place orders through this website.

5. Prices and payment methods

The sales prices for all BODEGAS ÓSCAR PÉREZ products are listed on the description sheet for each item. They are indicated in euros, include VAT or any applicable taxes that may apply at the time of ordering, and exclude shipping costs, which will be added to the total amount due and will be communicated to you in advance before finalizing the purchase. These prices are visible at all times.
Prices may change at any time, but will not affect contracts already entered into, that is, orders already placed. The prices reported will apply to the order unless there is an obvious error.
The accepted payment methods are credit card and bank transfer. No other payment methods will be accepted.
Payment is charged online, in real time, through the payment gateway of the corresponding financial institution, once the information provided has been verified as correct.
To ensure maximum security for the payment system, BODEGAS ÓSCAR PÉREZA uses secure payment systems from leading financial institutions in e-commerce.
In this regard, confidential data is transmitted directly and encrypted (SSL) to the corresponding financial institution. The SSL encryption system we use ensures complete security for data transmission over the network. Your data remains completely confidential and protected.
Credit card data is not recorded in any BODEGAS ÓSCAR PÉREZ database. It is only located in our financial institution’s virtual POS (Point of Sale Terminal), through its Secure Payment Gateway.
Credit cards will be subject to verification and authorization by the issuing institution. However, if said institution does not authorize payment, we will not be liable for any delay or non-delivery, nor will we be able to enter into any contract with you.
BODEGAS ÓSCAR PÉREZ reserves the right to verify the personal data provided by the Buyer and take any measures it deems appropriate (including canceling the order) to ensure that the purchased Product is delivered in accordance with the information provided in the order.

6. Shipping and Delivery

BODEGAS ÓSCAR PÉREZ undertakes to deliver the Products in perfect condition to the delivery address you have indicated on the order form. To this end, the User must provide the following information during the purchase process, which is essential for completing the transaction: full name, contact mobile phone number, and complete and detailed delivery address.

Once your order has been shipped, we unfortunately cannot make any address changes. Any address changes after shipping will incur a reshipping surcharge of €5.95, which must be paid by bank transfer to hola@bodegasoscarperez.com. If you believe you are on time and wish to change the shipping information, you can contact us by emailing hola@bodegasoscarperez.com.

Likewise, orders that have been shipped cannot be canceled. If you wish to cancel your order before receiving it, you must send us an email to hola@bodegasoscarperez.com notifying us of your intention to cancel your order and stating the reason for cancellation. We will do everything possible to accommodate your cancellation request.

To facilitate delivery, we suggest you provide an address where the order can be delivered during normal business hours. Please note that deliveries are made on weekdays (Monday to Friday), and products are not delivered on Saturdays, Sundays, or holidays.

Under no circumstances will shipments be made to PO boxes.

Delivery times will be notified to you at the time of placing your order, with an approximate lead time of between a minimum of 48-72 hours and a maximum of 5 business days (for shipments to the Peninsula and the Balearic Islands).
For shipments to the Canary Islands, Ceuta, and Melilla, the delivery time may be up to 7 business days.

If for any reason we are unable to meet the delivery date, we will inform you and give you the option to continue with the purchase by setting a new delivery date or cancel the order with a full refund of all amounts paid.
For the purposes of these Terms and Conditions, “delivery” or the Product will be deemed to have been “delivered” when you sign for receipt at the indicated delivery address.

7. Transfer of Risk and Ownership

The risk of the Products will be borne by you from the moment of delivery. You will acquire ownership of the Products upon receipt of full payment of all amounts due in respect of the Products, including shipping costs.

8. Shipping Costs

For shipments to mainland Spain, shipping costs will be a maximum of €10. For shipments to the Balearic Islands, shipping costs are €14. Shipping to the Canary Islands is carried out by courier. These shipments have a fixed cost of €37 and include (i) shipping and (ii) the corresponding export DUA (€23 fixed per shipment). It is important to note that this shipment will be subject to the additional payment of the import DUA and the corresponding IGIC (7% of the declared value on the invoice) at the time of delivery. These and any other applicable customs charges will be the buyer’s responsibility in all cases. For international shipments, please inquire at hola@bodegasoscarperez.com.

9. Right of withdrawal

Pursuant to Article 71 of the General Law for the Defense of Consumers and Users (LGDCU), if for any reason you are not satisfied with your order, you have 14 calendar days from the date of delivery of the Product to return it. You will be deemed to have acknowledged the right of withdrawal upon acceptance of these Terms and Conditions and placing your order.

To exercise your right of withdrawal, you must follow the following procedure:

Mark the Products you wish to return on the delivery note received with the package.
Include the Product to be returned in its original packaging with the delivery note. It is the Buyer’s responsibility to provide appropriate packaging to ensure that the Products arrive at BODEGAS ÓSCAR PÉREZ in perfect condition.
Send it to the following address: Calle Olmo 15, Briones (La Rioja)
Then send an email to hola@bodegasoscarperez.com informing us that you are withdrawing from the purchase and that you have returned the Products according to the return instructions provided.
We will acknowledge receipt of this withdrawal notification for your information.

It is very important that you return the Item to us in perfect condition and with no obvious signs of use. BODEGAS ÓSCAR PÉREZ will not accept the return of Products that are not in the same condition as when you received them. If the Products are damaged due to any circumstance attributable to the Buyer (including the packaging), we will not accept the return.

After examining the Item and verifying that all the above conditions are met, BODEGAS ÓSCAR PÉREZ will accept the return and proceed to refund the amounts paid. The refund will be issued for the full amount paid by the Buyer for the returned Item, including shipping costs. The refund will be issued using the same method used to pay for the returned Item. Please note that your bank may not show the refund amount in your balance until the following month.

In the case of defective products or incorrect shipments, the return procedure will be the same. In such cases, all return shipping costs will be borne by the Seller. In the case of unjustified withdrawal, the return shipping costs will be borne by the Buyer.

This provision does not affect the rights granted to consumers by current legislation.

10. Defective Products

At BODEGAS ÓSCAR PÉREZ, we carefully review and select our Products before shipping them to the Buyer. However, in the exceptional case that you receive a Product that is not in perfect condition and that you believe does not comply with the terms of the Contract, you may return it.

As a general rule, the steps to follow for returning defective Products are as follows:

  • Mark the defective Products on the delivery note received with the package.
  • Include the Product to be returned in its original packaging with the delivery note. It is the Buyer’s responsibility to provide adequate packaging to ensure that the Products arrive at BODEGAS ÓSCAR PÉREZ in perfect condition.
  • Send it to the following address: Calle Olmo 15, Briones (La Rioja)
  • Then send an email to hola@bodegasoscarperez.com providing us with the following information:
    • Buyer’s full name
    • Email address
    • Order number
    • Reason for return
    • Brief description of the damage or deterioration suffered by the Product
    • Date of receipt of order
    • Date of return

After carefully examining the returned Item and verifying that all the above conditions are met, we will inform you by email, within a reasonable time, whether a return is appropriate and, if applicable, whether we will refund the amounts paid or replace the defective Item.

In the event that the returned defective Product cannot be replaced, BODEGAS ÓSCAR PÉREZ will refund the full amount paid by the Buyer, including any expenses incurred in returning it to us.

Whether it’s a refund or a replacement item, BODEGAS ÓSCAR PÉREZ will process the refund as soon as possible and, in any case, within 30 days of the date of the email we sent confirming the return.
In the case of a refund, it will be issued using the same payment method used by the Buyer to pay for the returned item. Please note that your bank may not show the refund amount in your balance until the following month.

11. Warranty for Purchased Products

BODEGAS ÓSCAR PÉREZ Products purchased on our website are covered by a two-year legal warranty pursuant to Article 123 of the LGDCU. BODEGAS ÓSCAR PÉREZ does not provide any commercial warranty beyond the strictly legal warranty.
BODEGAS ÓSCAR PÉREZ will be liable for any non-conformity of the Products that becomes apparent within two (2) years of delivery.

Always in accordance with the LGDCU, in the event of a lack of conformity, the Buyer must inform us within two (2) months of becoming aware of it by sending an email to hola@bodegasoscarperez.com, indicating:

  • Your first and last name
  • Email address
  • Order number
  • Brief description of the anomaly detected

BODEGAS ÓSCAR PÉREZ will proceed, as appropriate, to repair the Product, replace it, reduce the price, or terminate the Contract. These actions will be free of charge for the Buyer.

12. Written Communications and Notifications

Applicable regulations require that some of the information or communications we send you be in writing. By using our website https://bodegasoscarperez.com, you agree that most of the communications you have with us will be electronic. Notifications you send us should preferably be sent through our email address hola@bodegasoscarperez.com.

BODEGAS ÓSCAR PÉREZ will contact you by email. For contractual purposes, you consent to the use of this electronic means of communication and acknowledge that all contracts, notices, information, and other communications we send you electronically comply with the legal requirements of being in writing. This condition will not affect your statutory rights.
Subject to the provisions of these Terms and Conditions, we may send communications to you either by email or to the postal address you provide when placing an order.

13. Assignment of Rights and Obligations

The Contract between you and BODEGAS ÓSCAR PÉREZ is binding on you and us, as well as on our respective successors, assigns, and assignees.

We may assign, encumber, subcontract, or otherwise transfer a Contract or any of the rights or obligations arising therefrom to us or to us at any time during the term of the Contract. For the avoidance of doubt, such transfers, assignments, encumbrances, or other transfers will not affect your statutory rights as a consumer, nor will they nullify, reduce, or otherwise limit any express or implied warranties we may have granted you. Similarly, the Buyer’s right to transfer any rights or obligations arising from the Contract is recognized, provided that this is not a commercial sale. The resale of BODEGAS ÓSCAR PÉREZ Products is expressly prohibited unless a Distribution Agreement is entered into between the Buyer and BODEGAS ÓSCAR PÉREZ.

14. Events beyond the control of BODEGAS ÓSCAR PÉREZ

BODEGAS ÓSCAR PÉREZ is not liable for any failure or delay in the performance of any of our obligations under the Contract due to events or occurrences caused by Force Majeure. Force Majeure events include any act, event, failure to perform, omission, or accident beyond our reasonable control. These include, but are not limited to, the following:

Strikes, lockouts, or other industrial action.
Civil commotion, riot, invasion, terrorist attack or terrorist threat, war (whether declared or not) or threat or preparation for war.
Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or any other natural disaster.
Inability to use trains, ships, aircraft, motor transport, or other means of transport, whether public or private.
Inability to use public or private telecommunications systems.
Acts, decrees, legislation, regulations, or restrictions of other governments.
Strikes, failures, or accidents involving maritime, inland waterway, postal, or any other form of transport.

While the Force Majeure event persists, our obligation to perform under any Contract will be deemed suspended, and we will have an extension of the period to perform our obligations while such circumstances persist. However, BODEGAS ÓSCAR PÉREZ will use all reasonable efforts to find a solution that allows us to fulfill our obligations under the Contract despite the Force Majeure event.

15. Modification of the Terms and Conditions

BODEGAS ÓSCAR PÉREZ may review and modify these Terms and Conditions at any time. You will be subject to the policies and Terms and Conditions in effect at the time you place each order.

16. Applicable Law and Jurisdiction

These Terms and Conditions are subject to Spanish law, and the Contracts for the sale of Products through our website are governed by Spanish law.

Any dispute arising between the Buyer and BODEGAS ÓSCAR PÉREZ will be submitted: i) to the Courts and Tribunals of the city of Madrid when the user is a business; or, ii) to the Courts and Tribunals of the city where the obligation must be fulfilled when the user is a consumer, in accordance with current legislation.
This clause does not affect the rights granted to you as a consumer and user by current legislation.

Bodegas Oscar Perez informs you that it is not affiliated with any extrajudicial dispute resolution system. Without prejudice to this, in order to comply with the information obligations imposed by EU Regulation No. 524/2013, you are hereby informed of the existence of the European platform for the resolution of consumer disputes, accessible via the Internet address http://ec.europa.eu/consumers/odr/.
